WHAT ABOUT A PRE-NUPTIAL AGREEMENT?
You may have read reports in the press of the landmark decision of the Supreme Court in the case of Radmacher v Granatino
(2010 UKSC 42). This case means that, upon divorce or dissolution of a civil partnership, a great deal of weight may be given to the terms of an agreement signed by the couple before they tie the knot. These agreements are not binding in the common sense of the word but they can be of decisive importance when they are drawn up correctly.
All right, it may not be very romantic, to talk about what you want to happen if you split up when you are just about to commit yourselves to a life together. But life is not a bed of roses and in a lot of circumstances, especially where you have children from a previous relationship, you need to be practical.
If you decide you want a pre-nuptial agreement, it is important that you both have expert legal advice and that the agreement is drawn up properly by a lawyer. Both our family law solicitors, Melanie Grant and Julia Weber, are experienced in drawing up nuptial agreements of all kinds and will be pleased to give you advice on what these agreements need to include.
