As recent national newspapers have reported, this is a growing area of practice  and  Jeremy F C Simmonds has dealt with several cases, so he has acquired detailed knowledge of the principles and precedents. In fact. one of his cases is itself a precedent on the issue of costs where a Claimant  refused to engage in informal mediation/round table meeting.

The main areas of dispute are:

  • under the  Inheritance (Provision for Family and Dependents)  Act 1975 which governs claims from family members and dependents  where is no reasonable provision for them in a will or as a result of intestacy
  • where there are concerns that a will may be invalid due to lack of knowledge ,undue influence  or duress
  •  equitable estoppel cases, where a claimant seeks provision in reliance on a promise made whilst the deceased was alive, the claimant having acted to his or her detriment in reliance on that  promise
