Introduction
As a parent, your natural instinct is to try to do what is best for your children. Sometimes, what you think is best conflicts with what someone else thinks is best. Most of that time that “someone else” is the child’s other parent, but it may also be a grandparent or a Social Worker. Hopefully, these conflicts can eventually be resolved by agreement but you may find yourself involved in court proceedings before then. Even so, agreement can still be reached during the course of court proceedings and, very occasionally, a court has to make the final decision for you.
Of course, every family is different and all sorts of individual questions can arise, but it will be helpful for you to have this brief outline of what happens if there have to be Court proceedings involving a child.
Most of the law relating to children is contained in the Children Act 1989. The law makes it quite clear that in all circumstances where this Act applies, the welfare of the child is of paramount importance.
