When a relationship breaks down, then the first decision may be to live apart, not immediately to divorce. There is no such thing as a “legal separation” in the sense that there is any statutory requirement to prove or record separation. The law treats you as separated because it is your intention to be separated.

It may be your wish to record the details of any agreement relating to children and/or finances in a formal document, called a “separation agreement”. We can prepare such a document for you and advise you generally on the kind of issues that should be considered on separation.

We can also advise on the need for you to consider making a new will in these circumstances.
